TERMS & CONDITIONS
– The lessee agrees to pay rental price for the equipment
rental. Should said equipment, or any part thereof, be lost, damaged
or destroyed, by fire, casualty of any kind, act of God or other
act or accident, the lessee agrees to pay the full value of the
equipment so lost, damaged, destroyed or detained, as well as
accrued rental therefore, according to the full replacement value
or in the event of damage the lessee agrees to pay the accrued
rental plus the cost of necessary repairs. Rent shall be due whether
or not such loss has occurred. Obligation to pay rent shall only
cease at the point of payment for all losses suffered be lessor.
RENTAL PERIOD --
Minimum rental period is one day. Equipment must be returned by
10:00 am to avoid any extra day charges. BERKELEY AVENUE
PRODUCTIONS offers convenient evening and nighttime pick-ups
and returns at no additional charge. Ask to make arrangements
ahead of time to assure availability.
CANCELLATIONS --
We require 24 hours notice of all cancellations. The lessee shall
compensate BERKELEY AVENUE PRODUCTIONS for any
loss that may occur due to cancellation by the lessee of all or
part of an order.
INSURANCE -- Lessee
shall provide their own insurance to cover retail value of equipment
rented, for all loss and damage. Rental cost will not be deducted
from replacement cost. Certificates of insurance, or verification
from insurance company that the certificates are forthcoming,
must be made available to BERKELEY AVENUE PRODUCTIONS,
prior to release of equipment. Lessee is responsible for the cost
of deductible. In addition BERKELEY AVENUE PRODUCTIONS
offers insurance at a reasonable rate, ask a representative. Pricing
varies depending on the size of the rental. Insurance from B.A.P.
ONLY covers equipment rented from B.A.P.
LIABILITY –
Lessee agrees to and does hereby indemnify lessor and hold lessor,
its agents and employees, harmless of and from any and all losses,
damages, claims, demands of liability of any kind or nature whatsoever,
including legal expenses, arising from the use, condition (including
without limitation latent and other defects) or operation of the
equipment rented, and by whosever used or operated during the
term hereof. This indemnification shall continue in full force
and effect during and after term of this rental for causes arising
during the term of this rental. Equipment is offered for inspection
and testing at the time of rental.
DAMAGED EQUIPMENT
-- All equipment is rented in good condition and is to be returned
in the same condition. Any repair work necessary shall be paid
by lessee. If unit is damaged beyond repair lessee shall pay full
replacement price. Equipment is offered for inspection and testing
at the time of rental.
GLOBES -- All units
are furnished with globes unless otherwise specified. Units rented
with globes are furnished with spare globes, quantity at our discretion
at no additional cost. No charge for burn outs if globe is returned.
DISCOUNTS -- BERKELEY
AVENUE PRODUCTIONS offers a 20% discount for qualified
student productions.
